H1B Visa Lawyer Blog Has Just Posted the Following:
The United States Citizenship and Immigration Service (USCIS) has updated the count (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=13ad2f8b69583210VgnVCM100000082ca60a RCRD) of H-1B petitions received and counted towards the 65,000 cap.
As of November 20, 2009, 56,900 H-1B cap subject nonimmigrant visa petitions have been filed with the USCIS. The Service has advised that they will continue to accept petitions until the cap is reached.
Qualifying applicants are still able to petition for an H-1B nonimmigrant visa (http://www.mvplawgroup.com/workvisas.php?action=h1bvisa) under the general cap.

Can I file I-485 for self and I-824 (application for changing AOS to CP for approved immigration petition) for dependents, if depedents won't be able to come within a year? If yes, how much time will take to transfer case from AOS to CP?

I applied for AP and EAD renewal in July 2010. I need to go to India by Oct 1st week for some personal work which can not wait beyond that time.
I am planing to expidite my AP if I wont get AP by then. What can I do with my EAD?
- Do I need to be present in US for EAD or I can leave US and ask my friend send EAD to India when it gets approved?
- If I go to India before EAD approval and if I am called for finger printing what are my options? Like, if I dont/cant come by the finger printing appointment date what happens ?
I appreciate for your reply.

Friends,
I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.
I will complete my 3 years. But after this project is over, I don't know I can find the job again.
My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?
What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.

It seems to me that USCIS are rejecting applications to establish new dates for refiling. Isn't it in their FAQ on Receipt delays that by law, they are required to issue EAD within 90 days from the applications?
I hope I am wrong but they might be doing this deliberately to get around the law.

I'm available for all aspects of Flash development from Flash video to ActionScript. One of the projects I'm currently working on is a virtual tour, fully updatable and dynamic.
I also understand and have developed AfterEffects peices for web publishing purposes. So if you need Flash animation, I can do that too. My lastest work was a FLV and Flash intro peice for Enyce.

I'm trying to show an "optimum" collection,
and so I'd really appreciate your listing here the numbers of some of the ones which you think I might as well omit, and any other suggestions.
Another really big favor would be to point me to some candids on the web. They're not easy and they seem not to be very popular.
